Congressional Democrats are preparing for a new fight with the Trump administration’s top financial regulators over the future of cryptocurrency in the United States. The dispute comes after lawmakers failed to reach an agreement on the Clarity Act, a major bill designed to create clearer rules for the growing digital asset industry.
With the legislation delayed, the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) are preparing to move forward with their own cryptocurrency policies. Paul Atkins, the SEC Chair, and Michael Selig, the CFTC Chair, have both indicated that their agencies are prepared to introduce new rules and guidance for the industry.
Democrats, however, are concerned about the direction of these efforts. Some lawmakers believe the regulators are too friendly toward cryptocurrency companies and could make it easier for the industry to operate without enough protection for investors and consumers.
Senator Elizabeth Warren has criticized the approach, arguing that the heads of the two agencies appear willing to do what the crypto industry wants. Senator Chris Van Hollen has also warned that the administration should not put the interests of cryptocurrency companies ahead of ordinary investors.
A major concern is that the agencies could be making important decisions that Congress should make through legislation. Critics say changes affecting financial markets should not be decided mainly through regulatory rules. They argue that Congress spent months negotiating the Clarity Act and that regulators should not effectively bypass that process.
The planned regulatory changes could also affect areas beyond cryptocurrency. The SEC is considering rules covering certain crypto assets, while it may also introduce an innovation exemption that would give companies greater flexibility when developing new financial products. The agency is also considering changes involving stock trading and other parts of the financial system.
Some traditional financial companies have expressed concerns about these proposals. They fear special exemptions for crypto businesses could create an uneven playing field and weaken protections that apply to other financial firms.
At the same time, regulators argue that waiting for Congress could leave the United States with continued uncertainty. They want to establish a framework that can help the country remain a leading center for digital assets while protecting its position in global financial markets.
However, the future of these rules remains uncertain. If Democrats regain control of Congress or take leadership positions at the agencies after the next election, they could attempt to reverse some of the Trump administration’s policies. New regulations could also face legal challenges in court, which could delay their implementation.
